Terms of Service for Mission Track Ping

The Mission Track System (MT) is a mobile-based emergency response management support system.

MT has been designed and developed, and is maintained, improved and marketed by Mission Track Ingeniería y Sistemas Sociedad Limitada (Mission Track, hereinafter).

MT is used by Mission Track Client Organizations as a tool to support Training, Coaching and Crisis and Emergency Management.

The Ping App has been designed and developed, and is maintained, improved and marketed by Mission Track, as a complement to MT, for use by Stakeholders (staff, clients, users, suppliers, etc.) of Mission Track Client Organizations that already use MT.

Ping is a mobile App whose functionality is to receive Notifications, in the form of text messages, sent by Organizations that already use MT.

Throughout these Terms of Use, “your Organization” refers to the Organization that has made it possible for you to be a Ping User by providing you with an alphanumeric code or QR code that enables you to subscribe to a Ping Channel.

As a Ping User, you may receive Notifications sent by your Organization through your subscription to Channels created by Mission Track for your Organization, upon request by your Organization. To do so, you must be informed of how to subscribe to such Channels by your Organization, by receiving, by any means, an alphanumeric code or QR code.

As a Ping User, you may, at any time, unsubscribe from the Channels to which you have previously subscribed, from the App itself. Unsubscribing from a Channel stops future deliveries, but does not delete the notices already received or the technical data associated with your profile.

Ping may not function properly in some scenarios that affect your mobile device, its configuration, your communications, the Computer or Communications Systems of the Organization that tries to send a Notification through a Channel, or those of some of your and/or our service providers, so it is the obligation and responsibility of your Organization to have the appropriate communication systems, under any circumstances, regardless of the availability status of Ping and MT.

Ping does not guarantee the permanence of the Channels to which you have subscribed, since some operations performed on your mobile device (uninstalling and installing the App, clearing cache, etc.), could eliminate the Channels to which you have subscribed. You can check the Channels you are currently subscribed to at any time from the App itself.

Uninstalling the App prevents you from continuing to use it and from receiving Notifications, but it does not communicate your deregistration or delete your profile data from the server. A reinstallation normally creates a new identity, although the operating system of your device may restore the previous session. If you wish to have your profile deleted, you can request it at dpd@missiontrack.es.

The authenticity of the sender for messages received by you as a Ping User is guaranteed by your Organization through the identification (MT username and password) of the MT user who sends a Notification via a Channel to its Ping users. The responsibility for the adequate safeguarding of the MT access data (username and password) of these MT users capable of sending Notifications via your Organization’s Ping Channels lies with them.

Mission Track Client Organizations that already use MT, and that can send Notifications via Ping channels, have committed not to use them for advertising, commercial or marketing purposes.

The content, veracity and timeliness of the Notifications received by you on Ping are the sole responsibility of the sender of the same. Mission Track is not responsible for the content, accuracy and timeliness of Notifications sent by MT users capable of sending Notifications through their Organization’s Ping Channels.

Notifications received by you on Ping are the sole responsibility of the issuer of the same, and in no case should they replace the emergency communication channels legally established by the competent public administrations.

Mission Track is not responsible for any results or losses (material, human, or of any other kind) that occur to you as a Ping user or to the Organization issuing Notifications through MT Channels, regardless of the use or non-use of MT and/or Ping, and the availability status of Ping and MT.

Ping does not request or require identifying Personal Data from you as a User: you are not asked for your name, email address or telephone number. Your Ping profile is pseudonymous: Mission Track does not directly know your identity, but it processes technical identifiers and session data that are considered pseudonymized personal data, as detailed in the Ping Privacy Policy. Ping does not collect the geolocation of your device either.

You are advised to review these Terms of Use periodically for changes. Changes to these Terms of Use become effective when they are posted on this page.
